Terms & Conditions

Welcome to Mergelings, a game developed and operated by Nine Tail Fox Rising ("we", "us", or "our"). By downloading, installing, or playing Mergelings (the "Game"), or by visiting ninetailfoxrising.com (the "Site"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Game or the Site.

1. Eligibility

You must be at least 13 years old to use the Game. If you are under the age of majority in your jurisdiction, you may only use the Game with the involvement of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. License to use the Game

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, solely for your personal, non-commercial entertainment.

You may not:

• Copy, modify, reverse engineer, decompile, or create derivative works of the Game;
• Rent, sell, sublicense, or otherwise commercially exploit the Game or any part of it;
• Use cheats, bots, automation, or unauthorized third-party software to manipulate gameplay;
• Exploit bugs or security vulnerabilities for unfair advantage;
• Use the Game to violate any law or the rights of any third party.

3. Accounts and progress

Your Game progress may be stored locally on your device or, where applicable, synced via Apple Game Center, Google Play Games, or other services. We are not responsible for progress lost due to device damage, uninstallation, or third-party service failure. Back up your data where possible.

4. In-app purchases

The Game may offer optional in-app purchases. All purchases are final and non-refundable except where required by law or by the policies of the Apple App Store or Google Play Store. Virtual items have no monetary value, cannot be exchanged for real money, and are licensed to you — not sold.

5. User content and conduct

If the Game allows you to choose names, usernames, or share content, you agree not to submit content that is unlawful, hateful, harassing, sexually explicit, infringing, or otherwise objectionable. We may remove content or suspend accounts that violate these Terms, at our sole discretion.

6. Intellectual property

The Game, Site, and all related content — including artwork, code, characters, music, logos, and the names "Mergelings" and "Nine Tail Fox Rising" — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7. Third-party services

The Game and Site may integrate third-party services (e.g. Apple, Google, analytics or advertising providers). Your use of those services is governed by their own terms and privacy policies. We are not responsible for their content or practices.

8. Updates and availability

We may update, modify, or discontinue the Game (or any feature) at any time without notice. We do not guarantee continuous, uninterrupted, or error-free operation of the Game.

9. Disclaimer of warranties

The Game and Site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Nine Tail Fox Rising will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Game or Site. Our total liability to you for any claim will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $10.

11. Termination

We may suspend or terminate your access to the Game at any time, with or without cause or notice. You may stop using the Game at any time by uninstalling it.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Nine Tail Fox Rising is established, without regard to its conflict-of-law provisions. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection laws of your country apply.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent version. Continued use of the Game after changes constitutes acceptance of the revised Terms.
